Mediation

Mediation is a faster, less expensive, and less stressful alternative to litigation, giving both parties more control over the outcome while reducing conflict.

Finding Peaceful Family Law Solutions Through Mediation

Traditionally, resolving divorce and child custody disputes meant going to court—a process that can be adversarial, stressful, and costly. Today, mediation offers a better alternative.

At Derby City Family Law, we proudly represent parties in mediations, helping families reach amicable, cost-effective resolutions without the need for prolonged litigation.

How Mediation Works

Mediation is a structured negotiation process that allows both parties to resolve disputes outside of court. Instead of presenting arguments before a judge, both spouses meet with a neutral third-party mediator, who facilitates discussions and guides them toward a mutually beneficial agreement.

While the mediator does not make decisions or take sides, they help both parties stay focused on resolving disputes regarding:

  • Property division
  • Parenting time (custody & visitation)
  • Child support & alimony
  • Debt division

Each parent may consult with their own attorney throughout the process. Once an agreement is reached, the terms are drafted into an official legal document and submitted to a judge for approval. If deemed fair, the agreement becomes legally binding.

Why Choose Mediation?

✔  Faster resolutions compared to drawn-out court battles

✔  Lower legal costs than traditional divorce proceedings

✔  Less stress & conflict, reducing emotional strain on families

✔  Greater control over decisions, rather than leaving them to a judge

✔  Protecting children from exposure to court proceedings and disputes

While mediation is not suitable for all cases, especially those involving domestic violence or significant power imbalances, it is a highly effective and preferred method for many couples.
